BAND INSTRUMENT RENTAL PURCHASE AGREEMENT
Rental Application Terms
Rental Program Overview
The initial deposit covers the first month’s rent. Monthly auto-pay installments will continue
one month after initial payment and continue each month while you are in possession of the
instrument or until all purchase payments have been made. If all payments are current, the
instrument may be returned at any time with no cancellation fees or further obligation.
Privacy and Security Statement
Rental Application is processed on a secure website hosted by third party servers with the
latest security features. Your information is encrypted upon submission using a random IV
with MCRYPT_RIJNDAEL_128 and MCRYPT_MODE_CBC symmetrical encryption. We are
committed to maintaining your private Information confidential and will restrict access to
your non-public information to only those employees who need to know such information in
order to obtain your credit report, service your account, or to enforce any term or condition
of the Agreement. Private information will not be shared with any other company as laid out
in the authorization agreement.
Authorization Agreement
By completing the rental application you authorize Spotts Music Center to make whatever
credit inquiries it deems necessary in connection with this credit application or in the course
of review or collection of any credit extended in reliance on this application. All information
set forth in this application is declared to be a true representation of the facts for the
purpose of obtaining the credit requested and any willful misrepresentation on this
application could result in criminal action. You have the right to request the information of
the name and address of the consumer reporting agency that furnishes the credit report.
You understand that all information provided is held in strict confidence and will not be
shared with any other party outside of the application process herein described.
Auto-Pay Authorization
By providing your credit/debit card information, you elect to make initial and future
payments due under the Rental/Purchase Agreement with the account listed. This option
authorizes Spotts Music Center to charge your debit/credit card account the total payment
amount due upon the due date of each payment. You are required to notify Spotts Music
Center in writing or at 1-800-227-7690 to update the credit/debit card account information
or to cancel this authorization.
Maintenance and Repair (M&R) Coverage
M&R Coverage will be extended to cover all necessary repairs, adjustments and labor
necessary to keep the instrument in proper playing condition. During the term of the
Rental/Purchase Agreement, there will be no charge for services performed. Damage that,
in our judgment, could have only been caused intentionally is not covered and is Leasee’s
responsibility to remedy. The M&R coverage is free for the initial 4-month trial period.
Insurance Coverage
You are not required to purchase insurance or liability damage waiver against loss or
damage to the rental property. However, you are responsible for the condition of the
instrument and may wish to do so for your protection. Refer to your personal
Homeowners/Renters Insurance Policy to determine extent of coverage or speak with your
insurance agent.
Right to Return and Termination of Rental/Purchase Agreement
You may return the instrument to Spotts Music Center at any time and have no further
obligations under the Agreement except to pay all rent due through the return date. We will
not refund any rental monies paid. To return the instrument, contact Spotts Music Center at
1-800-227-7690 to obtain a return authorization then physically return the instrument with
the case and all included accessories to the school music instructor or to a Spotts Music
Center location or authorized representative.
Security Interest
Spotts Music Center will retain title to the instrument until all rental/purchase installments
and related late charges have been made under the terms of the Rental/Purchase
Agreement. Spotts Music Center is granted a security interest in the instrument and
accssories as security for payment of due amounts.
Granting of Permission
As the legal parent or guardian of the named student, you authorize any teacher or
administrator of the school to release the instrument and/or any personal contact
information to our authorized representative for any reason we find necessary to fulfill the
specific terms of this Agreement. This authorization is pursuant to the Family Education
Rights and Privacy Act and any information obtained form any school representative will be
governed by the aforementioned Privacy and Security Statement.
Notice
You are renting the instrument and will not own it until all regularly scheduled payments are
made or the early purchase price obligations are met. You do not have the right to keep the
property if you do not make required payments or do not exercise the early purchase
option. Subject to your grace periods and reinstatement rights, the leassor may repossess
the property if you fail to make payments as scheduled. All specific rights, responsibilities
and obligations will be detailed in the Band Instrument Rental/Purchase Agreement that will
be mailed to you following account approval.
Warranties
All new instruments are covered by the respective, standard manufacturer’s warranty. As
such, Spotts Music Center does not warrant the instrument against defects in workmanship
